Terms of Service

These Terms of Service ("Terms") govern your use of Elements ("the Service"), operated by Elements ("we", "us"). By creating an account, you agree to be bound by these Terms.

1. Beta Status

The Service is currently offered as a private beta. Features may be incomplete, unstable, or change without notice. You should not rely on the Service for business-critical or production workloads during the beta period. We provide the Service on an "AS IS" and "AS AVAILABLE" basis.

2. Account Eligibility

• You must be at least 16 years old to create an account.
• You must provide accurate information and keep it up to date.
• You are responsible for the security of your credentials.
• One person or legal entity may maintain one free account.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe on intellectual-property, privacy, or publicity rights.
• Generate or distribute malware, spam, phishing content, or child sexual abuse material.
• Attempt to disrupt, overload, or gain unauthorized access to the Service or other users' accounts or data.
• Reverse-engineer, scrape, or automate the Service beyond the limits of your published rate limits and API keys.
• Train a competing AI product using our interfaces.

4. Your Content

You retain all rights to the pipelines, prompts, data, and outputs you create using the Service ("Your Content"). You grant us a limited, non-exclusive license to host, process, and transmit Your Content solely to operate the Service for you.

Third-party AI providers. When you execute a pipeline that calls OpenAI, Anthropic, Google, Groq, OpenRouter, or any other third-party model provider using your own API key, your prompts and responses are sent to that provider and are subject to their terms and privacy policies. We do not store these exchanges beyond what is needed for execution history, which you can delete at any time.

5. API Keys and Credentials

You are solely responsible for securing any third-party API keys you store in the Service's credentials vault. Credentials are encrypted at rest using AES-256-GCM, but no system is perfectly secure. Do not store keys whose compromise would cause you serious harm.

6. Rate Limits and Fair Use

The Service applies rate limits to protect availability for all users. Limits are documented and may be adjusted over time. Persistent attempts to circumvent rate limits may result in suspension of your account.

7. Intellectual Property

The Service itself — including its design, source code, branding, documentation, and underlying infrastructure — is owned by Elements Studio and protected by applicable intellectual-property laws. You may not copy, modify, redistribute, or create derivative works from the Service except as expressly permitted.

Output generated through your use of third-party AI models is governed by those providers' terms. We make no claim to ownership of AI-generated output you produce.

8. Termination

You can delete your account at any time from Settings → Danger Zone. Deletion is permanent and irreversible — all your pipelines, deployments, credentials, and execution history will be erased.

We may suspend or terminate your account if you materially violate these Terms, with notice where feasible. In cases of severe abuse (including but not limited to malware distribution or attacks on the Service), suspension may be immediate and without prior notice.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED OUTPUT MAY BE INACCURATE, BIASED, OR INAPPROPRIATE. YOU ARE RESPONSIBLE FOR REVIEWING AND VALIDATING IT BEFORE ACTING ON IT OR PASSING IT TO END USERS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED USD $100 OR THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold Elements harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your Content, or your misuse of the Service.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app and you will be asked to re-accept before continuing to use the Service. Continued use after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service will be resolved in the courts of Bhubaneswar, Odisha, India.
